廣東環(huán)宇京茂律師事務(wù)所創(chuàng)辦人、首席合伙人，一級(jí)律師，法學(xué)博士。
何培華博士是一個(gè)勇于挑戰(zhàn)、善于思考的人。何培華博士曾做過下鄉(xiāng)知青，1978年恢復(fù)高考后考上大學(xué)，畢業(yè)后成為一名英語老師；1985年，考入中國政法大學(xué)法律系，1987年畢業(yè)后又考入該校研究生院，師從中國法學(xué)泰斗江平教授，并于1988年通過律師資格考試，1991年取得民商法碩士學(xué)位。2000年至2001年期間，何培華博士赴美國哥倫比亞大學(xué)做訪問學(xué)者，從事國際商法、國際貿(mào)易法、外資并購等方面的法律制度研究；2001至2002年期間，前往美國戴維斯加州大學(xué)和伯克利加州大學(xué)攻讀國際商法碩士學(xué)位課程。2002年，何培華博士回國,考上中國政法大學(xué)民商經(jīng)濟(jì)法學(xué)院博士研究生，仍然師從江平教授，并于2005年獲得民商法學(xué)博士學(xué)位。
典型案件
1993年，何培華博士代理香港昆利發(fā)展有限公司起訴湛江海關(guān)的行政處罰糾紛訴訟案，作為當(dāng)時(shí)鮮有的“民告官”案件產(chǎn)生了重大影響，被最高人民法院列為典型案例；1997年，美國公民訴中國政府及廣東省土產(chǎn)進(jìn)出口集團(tuán)公司“中國馬牌”煙花爆炸索賠案，何培華博士以扎實(shí)的證據(jù)據(jù)理力爭(zhēng)，使原告5000萬美元的訴訟請(qǐng)求被駁回，維護(hù)了中國政府的主權(quán)和尊嚴(yán)，避免了中國政府的巨大損失，被中央電視臺(tái)、《人民日?qǐng)?bào)》、《美國僑報(bào)》等數(shù)十家海內(nèi)外媒體加以報(bào)道；2004年，湛江國聯(lián)水產(chǎn)輸美對(duì)蝦遭美國反傾銷調(diào)查，何培華博士作為湛江國聯(lián)水產(chǎn)的法律顧問為此提供了大量積極、具有建設(shè)性的法律意見，使得在同時(shí)被訴的大部分中國企業(yè)都承擔(dān)127%重關(guān)稅的時(shí)候，湛江國聯(lián)水產(chǎn)完全勝訴承擔(dān)0關(guān)稅；2008年，美國埃索拉公司向美國國際貿(mào)易委員會(huì)提請(qǐng)了對(duì)廣東生益科技股份有限公司侵犯其知識(shí)產(chǎn)權(quán)的337調(diào)查，何培華博士與美國知名律所合作，力挽狂瀾，使美國原告方撤訴，獲得了中國企業(yè)應(yīng)對(duì)美國337調(diào)查史上從未有過的勝利；2013年，甄子丹因名譽(yù)權(quán)被侵犯委托何培華博士作為代理人向法院提起訴訟，經(jīng)過多次開庭審理，法院于2015年最終認(rèn)定被告侵害甄子丹名譽(yù)權(quán)成立，判決被告向甄子丹公開道歉并賠償精神損失，此案被眾多媒體爭(zhēng)相報(bào)道。
曾任職務(wù)
何培華博士在做好律師本職工作之外，還曾擔(dān)任廣東省人大委員會(huì)立法顧問、中國國際經(jīng)濟(jì)法學(xué)會(huì)常務(wù)理事、廣東省律師協(xié)會(huì)第七屆和第八屆WTO法律專業(yè)委員會(huì)主任、中國法學(xué)會(huì)成員、中國政法大學(xué)兼職教授、中山大學(xué)法學(xué)院碩士生兼職導(dǎo)師、廈門大學(xué)國際經(jīng)濟(jì)法研究所兼職研究員和講座教授、暨南大學(xué)法律研究生導(dǎo)師、中國國際貿(mào)易促進(jìn)委員會(huì)調(diào)解中心調(diào)解員、廣東省法學(xué)會(huì)理事、華南國際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì)仲裁員、廣州仲裁委員會(huì)仲裁員、惠州仲裁委員會(huì)仲裁員、第十六屆亞運(yùn)會(huì)組委會(huì)律師顧問團(tuán)成員、廣東省國有資產(chǎn)管理委員會(huì)第一批入庫法律專家等等。2010年，何培華博士在該年度十大精英律師頒獎(jiǎng)大會(huì)上被評(píng)為年度國際貿(mào)易精英律師；2015年，何培華博士被評(píng)為該年度中國政法大學(xué)優(yōu)秀校友。
在執(zhí)業(yè)實(shí)踐的同時(shí)，何培華博士堅(jiān)持豐富理論知識(shí)，多年來，他筆耕不輟，參與編寫了《中國涉外經(jīng)濟(jì)法》和《新合同法原理與適用全書》，主編了《房地產(chǎn)》、《民商法律評(píng)論》等書，并在《中國國際經(jīng)濟(jì)法論叢》等刊物發(fā)表多篇論文。

Dr. Peihua He ：A Prominent Foreign-Related Lawyer
Dr. Peihua He
Dr. Peihua He is the founder and chief partner of Guangdong International Business Law Firm, a first-class lawyer and a doctor of law.
Dr. He always pursues excellence and thinks deeply. Dr. He once worked as an educated youth in the countryside. After the resumption of the college entrance examination in 1978, he was admitted to a university and became an English teacher after graduation. In 1985, he was admitted to the Law Department of China University of Political Science and Law (CUPL) and continued his studies in the graduate school of CUPL from professor Ping Jiang, one of the most eminent legal scholars in China, after graduating with a bachelor’s degree in 1987. Dr. He passed the bar in 1988 and obtained a master’s degree in civil and commercial law in 1991. From 2000 to 2001, Dr. He went to Columbia University as a visiting scholar, engaged in legal system research on international commercial law, international trade law, and foreign mergers and acquisitions. From 2001 to 2002, Dr. He went to the University of California, Davis and the University of California, Berkeley, to pursue a master's degree in International Business Law. In 2002, Dr. He was admitted to CUPL as a Ph.D. student, still under the tutelage of Professor Ping Jiang, and obtained a Doctor of Civil and Commercial Law in 2005.
Noticeable Litigation Cases
In 1993, Dr. He represented Hong Kong Kunli Development Ltd to sue Zhanjiang Customs in an administrative penalty dispute lawsuit. As a rare case of "people suing officials" at that time, it had a significant impact and was listed as a typical case by the Supreme People's Court. In 1997, a US citizen sued the Chinese government and Guangdong Local Products Import& Export Corporation for a claim for the "China Continental" fireworks explosion. Dr. He argued with solid evidence to make the plaintiff's $50 million claim dismissed, safeguarded the sovereignty and dignity of Chinese government, and avoided huge losses of it. That case has been reported by dozens of domestic and overseas media such as CCTV, People's Daily, and American Overseas Chinese News. In 2004, Zhanjiang Guolian Aquatic Products Ltd (ZGAPC) was subject to an anti-dumping investigation by the United States on its export of prawns to the United States. As the legal counsel of ZGAPC, Dr. He provided a lot of constructive legal opinions, which made ZGAPC completely win the case, bearing no tariffs, while most of the other Chinese companies sued had to bear the heavy 127% tariffs. In 2008, Esola Ltd submitted an application to the US International Trade Commission, claiming that Guangdong Shengyi Technology Ltd infringed its intellectual property rights, and called for a Section 337 investigation. Dr. He cooperated with a well-known American law firm and successfully withdrew the plaintiff's lawsuit, winning an unprecedented victory for Chinese companies in the history of the US Section 337 investigation. In 2013, Donnie Yen entrusted Dr. He Peihua as an agent to file a lawsuit with the court due to the infringement of his reputation. After several trials, the court finally found that the defendant's infringement of Donnie Yen's reputation was established in 2015, and ordered the defendant to apologize to Donnie Yen publicly and compensate for the mental damage. The case has been covered by many media.

In addition to his work as a lawyer, Dr. He has also held positions as follow: Legislative Consultant of the Guangdong Provincial People's Congress, Executive Director of China International Economic Law Society, Director of the Seventh and Eighth WTO Legal Professional Committee of Guangdong Lawyers Association, part-time professor of China University of Political Science and Law, part-time tutor of master students of Sun Yat-sen University Law School, part-time researcher and chair professor of Xiamen University Institute of International Economic Law, tutor of law graduate students of Jinan University, mediator of China Council for the Promotion of International Trade Mediation Center, Director of Guangdong Law Society, Arbitrator of South China International Economic and Trade Arbitration Commission, Arbitrator of Guangzhou Arbitration Commission, Arbitrator of Huizhou Arbitration Commission, Member of the Legal Advisory Group of the Organizing Committee of the 16th Asian Games, and one of the first batch of State-owned Assets Management Commission of Guangdong Province legal experts, etc.
In 2010, Dr. He was selected as the International Trade Elite Lawyer of the Year. In 2015, Dr. He was selected as the outstanding alumni of CUPL.
Dr. He has always insisted on enriching theoretical knowledge while practicing as a lawyer. Over the years, Dr. He has published several papers in "China International Economic Law Series" and other publications. He has also participated in the compilation of "China's Foreign Economic Law" ,"The Principles and Application of New Contract Law", "Real Estate", "Civil and Commercial Law Review" and other journals.
